CANCELLATION: Client acknowledges that in the event of a session cancellation, the Photographer will incur expenses for financial loss. The retainer fee is due to the customization of each session, and the inability of Photographer to perform other sessions during time reserved for Client. If Photographer has received a retainer for scheduled session, Client will not be entitled to a refund if he/she cancels the session. Balance for the session will be due the day before the session and will be required to insure the following day.
DIGITAL IMAGES: Back up all digital images regardless of how client received the images (dropbox, disc, or USB). All sessions are transferred to a external hard drive after the sessions are completed and additional fees will be required to re-create or provide replacements for clients.
MODEL RELEASE: Client shall permit the Studio to use images of Client from any portion of the Work for display, Studio’s website, publication, social media, or other promotional uses without payment of additional compensation or Client/Clients' agents. Not everyone is comfortable with online sharing, please specify this with me and Id be happy to accommodate your wishes and privacy.
COPYRIGHT AND LICENSING NOTICE:The images that are being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: printing, copying and emailing. Heather Ann Photography may revoke this license at any time and for any reason. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Heather Ann Photography requests that if you choose to share any images on FB, that you give credit to Heather Ann Photography through tagging the photos with my business page. If you need help understanding how to do this, please ask. Any images shared through social media MAY NOT BE ALTERED IN ANY WAY including, but not limited to cropping or any editting done to alter the original artistic intent of the artist (Heather Ann Photography). Your purchase of the original files release Heather Ann Photography from any liability due to loss or damage of the images, and also releases Heather Ann Photography from any obligation to maintain copies of any digital file, image, or photograph. You hereby grant to Heather Ann Photography the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, website, display, advertisement, and editorial use. Heather Ann Photography retains all copyrights to the images and derivative works thereof. By retaining the services of Heather Ann Photography and the use of any of these images, you are agreeing to the above terms. Copyright infringement is NOT tolerated and will result in lawsuits up to but not limited to $10,000.
By signing the contract you have agreed to paying the retainer required for booking (this doesn’t include the remaining session fee due the day before the scheduled date) You also agree to pay the set session balance amount once the session takes place. Should the session take place and balance is not paid, legal action and late charges will be added.
